These Terms & Conditions ("Terms") govern your use of the eConsultantz website and any services we provide. By accessing our website or engaging our services, you agree to these Terms. If you do not agree, please do not use our website or services.
1. Our services
eConsultantz provides web design, web development, digital marketing, search engine optimisation, and paid advertising services (including Google Ads and social media advertising). The specific scope, deliverables and timelines for any engagement will be set out in a separate quote, proposal or agreement.
2. Quotes and proposals
Quotes and proposals are provided for information and are valid for the period stated. A project begins once both parties agree on scope and any required deposit or payment terms are met.
3. Payment
Fees, payment schedules and any deposits will be defined in your project agreement. Unless otherwise agreed, invoices are due within the stated period. Late payments may result in paused work.
4. Client responsibilities
- Provide accurate information, content and materials needed to complete the work.
- Respond to requests for feedback or approval in a timely manner.
- Ensure you have the rights to any content, logos or materials you provide to us.
5. Intellectual property
Upon full payment, you own the final deliverables created specifically for you, except for third-party components, stock assets, and our own pre-existing tools or frameworks, which remain the property of their respective owners or of eConsultantz. We may showcase completed work in our portfolio unless otherwise agreed in writing.
6. Third-party services and platforms
Our services may rely on third-party platforms (such as hosting, advertising networks and analytics providers). Your use of those platforms is subject to their own terms, and we are not responsible for their availability, performance or policies.
7. Advertising results
We work to improve your visibility and lead generation, but we cannot guarantee specific rankings, traffic, leads or sales, as these depend on factors outside our control, including third-party algorithms and market conditions.
8. Warranties and disclaimers
Our website and services are provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law.
9. Limitation of liability
To the maximum extent permitted by law, eConsultantz will not be liable for any indirect, incidental, special or consequential damages, or for any loss of profits, revenue or data arising from your use of our website or services. Our total liability for any claim will not exceed the amount you paid us for the relevant services.
10. Termination
Either party may terminate an engagement as set out in the project agreement. Fees for work completed up to the termination date remain payable.
11. Governing law
These Terms are governed by the laws of the State of New Jersey, USA, without regard to its conflict of law principles. Any disputes will be subject to the courts located in New Jersey.
12. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above reflects the most recent version. Continued use of our website or services after changes indicates your acceptance of the updated Terms.
